True Parole in Florida: How It Works

Florida parole is governed by the Florida Commission on Offender Review, a quasi-judicial state body that operates separately from the criminal courts. The Commission makes decisions about parole grants, conditions, and revocations. Florida effectively ended parole eligibility for crimes committed on or after October 1, 1983, when sentencing guidelines took effect. True parole today generally applies to individuals whose offenses occurred before that date or under narrow statutory exceptions. The Commission also handles revocation of related post-release supervision programs, including conditional release.

What Happens After an Alleged Violation

When a parole violation is alleged, the FCOR process begins with a preliminary hearing to determine whether there is probable cause to proceed. If it does proceed, a final revocation hearing follows before the Commission, not a circuit court judge. You have the right to retain private counsel for these hearings, and having an attorney at the preliminary stage can shape everything that follows.

One important difference from criminal court: the Commission can consider evidence that would be excluded in a standard criminal proceeding under the federal exclusionary rule. After the final hearing, the Commission may revoke parole and return you to prison to serve the remainder of your original sentence, reinstate your parole with the same or modified conditions, place you in a community control program, or enter another order it finds appropriate.
