Difference Between Injunction and Restraining Order in Florida

An injunction can be asked of the court if an individual hasn't been convicted of a crime. A restraining order, on the other hand, is issued at the close of a criminal case. A restraining order may be sought as immediate protection while in pursuit of an official injunction. Injunctions and restraining orders issued in Florida are are enforceable throughout the nation.

Types of Injunctions in Florida

The state of Florida allows individuals to request five different types of injunctions, or protective orders. In any instance, a judge may grant a temporary injunction, which stays in effect until both the person seeking the injunction and the respondent (or the person who has had the injunction placed against them) can attend a hearing.

The different types of restraining orders available in Florida include:

  • Domestic Violence Injunction
  • Stalking Injunction
  • Dating Violence Injunction
  • Sexual Violence Injunction
  • Repeat Violence Injunction

While each type of injunction is slightly different from the next, all have similar consequences for the respondent. In all cases, an injunction prevents the respondent from contacting the victim in any way—whether in person, by phone, via email, or online. In certain cases, an injunction will prevent the respondent from seeing his or her children and may require the respondent to forfeit his or her right to own a firearm/ammunition. Additionally, violations of injunctions come with serious penalties, including but not limited to jail time.
