What Florida Law Requires to Convict

Florida Statute 784.021 defines aggravated assault as an assault committed either with a deadly weapon without intent to kill, or with intent to commit a felony. That sounds straightforward, but the prosecution has to prove every element: that the defendant made an intentional and unlawful threat by word or act, had the apparent ability to carry it out, caused a well-founded fear of imminent violence in the alleged victim, and did so with a deadly weapon or while intending to commit another felony.

No physical contact is required. A threat alone, if the other elements are present, can support the charge. Florida courts have also applied a broad definition of “deadly weapon,” finding that bottles, bats, and vehicles can qualify when used or threatened to be used in a way likely to cause death or great bodily harm. Each of those elements is also a potential point of attack in the defense.

Penalties for Aggravated Assault in Florida

Aggravated assault is a third-degree felony, carrying up to 5 years in prison, up to 5 years of probation, and a fine of up to $5,000. The charge can be reclassified to a second-degree felony, raising the maximum prison exposure to 15 years, when the alleged victim is a law enforcement officer, firefighter, or emergency medical care provider acting in the line of duty, a person 65 or older, or certain school employees. These protected-class enhancements change the stakes significantly, and determining whether one applies is part of every initial case assessment.

One notable statutory change: standalone aggravated assault was removed from Florida’s 10-20-Life mandatory minimum sentencing law for offenses on or after July 1, 2016, and that change was later applied retroactively to earlier offenses not yet sentenced under the old statute.
